Investment protection contracts are major hurdles for climate protection

PowerShift contribution to the OECD consultation process

The OECD conducted a consultation on investment protection treaties and climate action in March 2022, in which PowerShift also participated. In the consultation letter, we highlight why investment protection is a major hurdle to effective climate protection: For example, the risk of claims by fossil-fuel companies before investment arbitration courts leads states to take less ambitious climate protection measures out of fear of high compensation payments. The energy transition is thus becoming more expensive and slower, and its costs are being redistributed from fossil-fuel companies to the general public.
