When the dead are resurrected

How the EU is trying to breathe new life into investment protection

Corporations can sue states in private arbitration courts if, for example, they lose profits through health regulations or climate protection laws. An unjust system against which hundreds of thousands of people across Europe took to the streets and voted over 150,000 in an online consultation conducted by the EU in 2014. Now, through reforms, the EU Commission and national governments are trying to save the system of corporate lawsuits. The issue is also being debated at the UN level.

In this FactSheet, we deal with the EU proposal of the Multilateral Court of Justice (MIC) as a possible reform of the corporate litigation system. What is the status quo? What would the MIC change, or maybe it doesn't change anything at all and is more of a beauty correction?  These and other questions, including on the negotiations at UN level, are answered in this FactSheet.
