Since the end of TTIP, it has become quieter around them, but corporate lawsuits continue to threaten progressive policies in Europe and worldwide. Before non-transparent arbitral tribunals, states are sued for billions, past parliaments and the public. States are asked to pay if they get out of coal. Oligarchs use non-transparent arbitral tribunals to take action against sanctions imposed on them. Billionaires prevent the collection of the excess profit tax with corporate lawsuits. At the same time, it is European investors who have filed the most lawsuits worldwide.
But more and more resistance is forming against the corporate lawsuit system. The EU and many member countries have withdrawn from the Energy Charter Treaty, which was responsible for many lawsuits. At international climate conferences, the danger of corporate lawsuits against the energy transition is now on the agenda.
