Un simple <strong>\u00abNon au RDIE\u00bb<\/strong> C'est tout \u00e0 fait suffisant. Les messages cr\u00e9atifs sont \u00e9galement les bienvenus.<\/p>\n<h3>2. PowerShift s'engage \u00e0 mettre fin \u00e0 ces droits sp\u00e9ciaux pour les investisseurs.<\/p>\n<h3>Exemple de sortie du charbon<\/h3>\n<p>La sortie allemande du charbon a \u00e9t\u00e9 entrav\u00e9e \u00e0 plusieurs reprises par des recours collectifs. Avec les deux entreprises de lignite RWE et LEAG, le gouvernement f\u00e9d\u00e9ral a n\u00e9goci\u00e9 une renonciation \u00e0 leurs actions en justice du groupe. <a href=\"https:\/\/power-shift.de\/fr\/ect-erhoeht-kosten-kohleausstieg\/\">Ceux-ci se sont fait payer cher et ont re\u00e7u un paiement de milliards, entre autres pour l'engagement de ne pas intenter de poursuites arbitrales<\/a>. Lors de la sortie de la houille <a href=\"https:\/\/power-shift.de\/fr\/briefing-gefaehrlicher-praezedenzfall-schiedsgerichtsklage\/\">L'entreprise suisse AET r\u00e9clame une indemnisation de plusieurs millions de francs devant un tribunal arbitral<\/a>. AET souhaite recevoir des recettes hypoth\u00e9tiques de la centrale au charbon \u00e0 partir de l\u2019argent des contribuables d\u2019ici \u00e0 2053, alors que l\u2019Allemagne doit d\u00e9j\u00e0 \u00eatre neutre pour le climat en 2045.<\/p>\n<p><strong>Exemple : Sanctions contre les oligarques russes<\/strong><\/p>\n<p>\u00c0 la suite de l\u2019invasion de l\u2019Ukraine par la Russie, l\u2019UE et l\u2019Ukraine ont impos\u00e9 d\u2019importantes sanctions aux entreprises et aux oligarques russes. <a href=\"https:\/\/power-shift.de\/en\/russian-oligarchs-sue-over-sanctions\/\">Dans plus de 28 cas, ceux-ci ont recours \u00e0 des recours collectifs pour faire face aux sanctions.<\/a>. Bien que les demandes d\u2019indemnisation ne soient pas connues pour de nombreuses actions en justice, le montant des actions en justice intent\u00e9es et menac\u00e9es s\u2019\u00e9l\u00e8ve \u00e0 plus de 60 milliards de dollars. Par cons\u00e9quent, les tribunaux d\u2019arbitrage sont d\u00e9sormais \u00e9galement utilis\u00e9s pour saper la politique de s\u00e9curit\u00e9 de l\u2019UE et de l\u2019Ukraine.<\/p>\n<h3>Les tribunaux arbitraux, une \u00abarme secr\u00e8te\u00bb pour les entreprises et les oligarques<\/h3>\n<p>Ce n'est pas un cas isol\u00e9: \u00c0 maintes reprises, lorsque des lois adopt\u00e9es d\u00e9mocratiquement ou de nouvelles r\u00e9glementations en mati\u00e8re de climat et d\u2019environnement limitent les b\u00e9n\u00e9fices des investisseurs internationaux, ceux-ci recourent \u00e0 l\u2019\u00abarme secr\u00e8te\u00bb que sont les tribunaux arbitraux. La politique de s\u00e9curit\u00e9 est \u00e9galement de plus en plus dans le collimateur. Au total, huit poursuites collectives ont \u00e9t\u00e9 rendues publiques, notamment contre la sortie du nucl\u00e9aire et du charbon, ainsi que contre l'imp\u00f4t sur les b\u00e9n\u00e9fices exc\u00e9dentaires et les sanctions li\u00e9es \u00e0 l'Ukraine.
