PowerShift s'engage \u00e0 mettre fin \u00e0 ces tribunaux d'arbitrage pour les investisseurs.<\/p>\n<h3>Exemple : RWE et Uniper contre les Pays-Bas<\/h3>\n<p>Peu de temps apr\u00e8s que le gouvernement n\u00e9erlandais a adopt\u00e9 une loi de sortie du charbon afin de respecter ses engagements internationaux en mati\u00e8re de climat, deux plaintes ont \u00e9t\u00e9 d\u00e9pos\u00e9es par les groupes \u00e9nerg\u00e9tiques allemands RWE et Uniper. Ensemble, ils ont r\u00e9clam\u00e9 pr\u00e8s de 2,4 milliards d'euros de compensation pour la sortie du charbon n\u00e9erlandais d'ici 2030, car leurs centrales \u00e9lectriques peuvent maintenant fonctionner plus rapidement que pr\u00e9vu initialement. Leurs plaintes, qui ont depuis \u00e9t\u00e9 retir\u00e9es, ont \u00e9t\u00e9 port\u00e9es devant des tribunaux arbitraux priv\u00e9s.<\/p>\n<h3>Les tribunaux arbitraux, un \u00abmiracle\u00bb pour les groupes<\/h3>\n<p>Ce n'est pas un cas isol\u00e9: \u00c0 maintes reprises, lorsque des lois adopt\u00e9es d\u00e9mocratiquement ou de nouvelles r\u00e9glementations en mati\u00e8re de climat et d\u2019environnement limitent les b\u00e9n\u00e9fices des investisseurs internationaux, ceux-ci recourent au \u00abmiracle\u00bb que sont les tribunaux arbitraux. Les tribunaux d'arbitrage offrent des avantages \u00e9vidents \u00e0 ces investisseurs:<\/p>\n<ul>\n<li>Les proc\u00e9dures sont conduites par trois arbitres, dont deux peuvent \u00eatre d\u00e9sign\u00e9es par les investisseurs requ\u00e9rants.<\/li>\n<li>R\u00e9clamation de gains hypoth\u00e9tiques: Les investisseurs peuvent r\u00e9clamer des b\u00e9n\u00e9fices futurs hypoth\u00e9tiques, ce qui ne serait pas possible en droit national ou europ\u00e9en.<\/li>\n<li>La protection du climat, les droits de l'homme et l'\u00e9quilibre social ne jouent aucun r\u00f4le dans ces proc\u00e9dures.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3>Plus de 1 300 plaintes d'entreprises dans le monde<\/h3>\n<p>Dans le monde entier, il y a maintenant plus de 1300 de ces poursuites, la plupart dirig\u00e9es contre des \u00c9tats du Sud. <a href=\"https:\/\/www.globalisdstracker.org\/\">Comment nous avons document\u00e9 sur un site Web<\/a>, Les \u00c9tats ont \u00e9t\u00e9 poursuivis pour plus de 850 milliards de dollars et les investisseurs ont \u00e9t\u00e9 en mesure d'obtenir plus de 110 milliards de dollars de l'argent des contribuables par le biais de poursuites collectives. La plupart des plaintes et des montants d'indemnisation les plus \u00e9lev\u00e9s sont dans le domaine de l'industrie fossile. Celle-ci utilise le syst\u00e8me de poursuites collectives pour lutter contre les mesures de protection du climat. Ainsi, l'entreprise suisse AET poursuit actuellement la R\u00e9publique f\u00e9d\u00e9rale d'Allemagne en raison de l'abandon progressif de la houille.<\/p>\n<h3>Protection des investissements: Un probl\u00e8me pour l'Allemagne<\/h3>\n<p>Ces actions sont rendues possibles par des trait\u00e9s intergouvernementaux de protection des investissements qui permettent aux investisseurs de saisir des tribunaux d'arbitrage priv\u00e9s. L'Allemagne a conclu la plupart de ces contrats, soit 114 au total. En outre, les investisseurs allemands ont intent\u00e9 la quatri\u00e8me plus grande action en justice au monde, tandis que la R\u00e9publique f\u00e9d\u00e9rale d'Allemagne a elle-m\u00eame \u00e9t\u00e9 poursuivie \u00e0 six reprises. L'Allemagne est donc l'un des principaux pays du syst\u00e8me d'action collective.<br \/>\nLes six plaintes contre l'Allemagne ont toutes \u00e9t\u00e9 d\u00e9pos\u00e9es en vertu du trait\u00e9 sur la Charte de l'\u00e9nergie, un accord de protection des investissements dans le domaine de l'\u00e9nergie qui a suscit\u00e9 plus de plaintes que tout autre accord. Entre-temps, l'Allemagne, l'UE et dix autres pays ont quitt\u00e9 le trait\u00e9 sur la Charte de l'\u00e9nergie. Apr\u00e8s cette \u00e9tape importante, il est maintenant imp\u00e9ratif que les \u00c9tats sortants concluent entre eux un accord qui exclut les poursuites futures. PowerShift s'engage r\u00e9solument en ce sens.<\/p>\n<h3>Nos revendications: Fini les poursuites collectives<\/h3>\n<p>PowerShift demande:<\/p>\n<ul>\n<li>R\u00e9siliation des contrats de protection des investissements existants: L'Allemagne a conclu 114 de ces contrats, plus que tout autre pays.<\/li>\n<li>Pas de nouveaux accords de libre-\u00e9change avec les multinationales: Malgr\u00e9 la promesse de la coalition des feux de circulation, il n'y a pas eu d'initiatives pour s'attaquer au probl\u00e8me des poursuites collectives.
