{"id":85413,"date":"2023-07-12T14:48:16","date_gmt":"2023-07-12T12:48:16","guid":{"rendered":"https:\/\/power-shift.de\/?p=85413"},"modified":"2025-09-15T22:05:29","modified_gmt":"2025-09-15T20:05:29","slug":"position-paper-critical-raw-material-act","status":"publish","type":"post","link":"https:\/\/power-shift.de\/en\/position-paper-critical-raw-material-act\/","title":{"rendered":"Position Paper: The Critical Raw Material Act\u2019s needs for a Social and Just Green Transition"},"content":{"rendered":"<p>In September 2022, EU Commission President Ursula von der Leyen announced \u201ca European law on critical raw materials\u201d in her State of the EU address the Critical Raw Materials Act (CRMA). \u201cWe will work on strategic projects along the entire supply chain \u2013 from extraction to refining, from processing to recycling,\u201d she added. After a very short consultation period, the EU Commission presented its proposal in March 2023. As in the Commission President\u2019s announcement, the strategic projects are the core of the CRMA. At the same time, they are one of the central risks for environmental and human rights protection. This is because, according to the EU Commission, strategic projects are to be identified inside and outside the EU and then prioritised over other interests \u2013 e.g. nature conservation. The many human rights risks that have been addressed by various legislations in recent years are also not reflected in the law. Instead, the CRMA positions on certificates or the intention to engage in a voluntary, private industry association to be managed as a strategic project. With this kind of acceleration, both environmental and health risk compliance audits and democratic participation procedures are in danger of being massively ground down.<\/p>\n<p>More than 40 European environmental and human rights organisations have together formulated demands for this law. These include:<\/p>\n<p><span id=\"page33R_mcid2\" class=\"markedContent\"><span dir=\"ltr\">1. The EU should<\/span> <span dir=\"ltr\">actively reduce its dependence on primary raw materials<\/span> <span dir=\"ltr\">and <\/span><span dir=\"ltr\">implement demand<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">side solutions to decrease critical raw materials consumption by at <\/span><span dir=\"ltr\">least 10% by 2030, including phasing out single<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">use products containing critical raw<\/span> <span dir=\"ltr\">materials, implementing a material passport system, and adopting national program<\/span><span dir=\"ltr\">s <\/span><span dir=\"ltr\">Promote material efficiency and the use of alternative materials.<\/span><\/span><span id=\"page33R_mcid3\" class=\"markedContent\"><\/span><span id=\"page33R_mcid4\" class=\"markedContent\"><br \/>\n<\/span><\/p>\n<p><span id=\"page33R_mcid4\" class=\"markedContent\"><span dir=\"ltr\">2.<\/span> <span dir=\"ltr\">The CRMA should<\/span> <span dir=\"ltr\">not rely solely on certification schemes<\/span><span dir=\"ltr\">, as certification alone does<\/span> <span dir=\"ltr\">not guarantee compliance with mandatory human rights and environmental <\/span><span dir=\"ltr\">regulations; Instead, a bro<\/span><span dir=\"ltr\">ader assessment of human rights and environmental<\/span> <span dir=\"ltr\">Performance should be conducted. If certification schemes are used as one tool of <\/span><span dir=\"ltr\">Many, they have to include certain criteria as minimum a multi<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">stakeholder <\/span><span dir=\"ltr\">governance, adherence to comprehensive standards,<\/span> <span dir=\"ltr\">disclosure rules, accessible<\/span> <span dir=\"ltr\">Grievance mechanisms, and public audit reports.<\/span><\/span><span id=\"page33R_mcid5\" class=\"markedContent\"><\/span><span id=\"page33R_mcid6\" class=\"markedContent\"><br \/>\n<\/span><\/p>\n<p><span id=\"page33R_mcid6\" class=\"markedContent\"><span dir=\"ltr\">3.<\/span> <span dir=\"ltr\">The CRMA\u2019s focus on EU supply security through partnerships lacks a global justice<\/span> <span dir=\"ltr\">approach. Including concrete measures to ensure sustainability standards, civil society <\/span><span dir=\"ltr\">partic<\/span><span dir=\"ltr\">ipation, and the protection of human rights and the environment in third<\/span> <span dir=\"ltr\">countries. Our recommendations include<\/span> <span dir=\"ltr\">aligning partnerships with international <\/span><span dir=\"ltr\">agreements<\/span><span dir=\"ltr\">, implementing<\/span> <span dir=\"ltr\">robust monitoring and remediation mechanisms<\/span><span dir=\"ltr\">, defining <\/span><span dir=\"ltr\">\u201cvalue addition,\u201d suppo<\/span><span dir=\"ltr\">rting domestic industrialisation,<\/span> <span dir=\"ltr\">involving civil society and<\/span> <span dir=\"ltr\">Indigenous peoples<\/span><span dir=\"ltr\">, ensuring transparency, and avoiding the undermining of <\/span><span dir=\"ltr\">commitments through other regulations or trade agreements.<\/span><\/span><span id=\"page33R_mcid7\" class=\"markedContent\"><\/span><span id=\"page33R_mcid8\" class=\"markedContent\"><br \/>\n<\/span><\/p>\n<p><span id=\"page33R_mcid8\" class=\"markedContent\"><span dir=\"ltr\">4.<\/span> <span dir=\"ltr\">The CRMA\u2019s focus on accelerating permitting procedures for Strategic Projects risks<\/span> <span dir=\"ltr\">bypassing environmental and social safeguards and lacks public buy<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">in.<\/span> <span dir=\"ltr\">Streamlined <\/span><span dir=\"ltr\">permitting must not come at the cost of environmental protection, meaningful<\/span> <span dir=\"ltr\">public parti<\/span><span dir=\"ltr\">cipation.<\/span> <span dir=\"ltr\">Incorporating elements like Free, Prior, and Informed Consent<\/span> <span dir=\"ltr\">(FPIC) and Indigenous rights must be at the center of strategic projects. So, <\/span><span dir=\"ltr\">resources to licensing authorities have to be shared, international agreements<\/span> <span dir=\"ltr\">referenced, tr<\/span><span dir=\"ltr\">ansparency repeatedly and a subgroup on sustainability and responsible <\/span><span dir=\"ltr\">mining within the European Critical Raw Materials Board established. Deep<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">sea <\/span><span dir=\"ltr\">Mining due to potential environmental and social impacts has to be prohibited.<\/span><\/span><span id=\"page33R_mcid9\" class=\"markedContent\"><\/span><span id=\"page33R_mcid10\" class=\"markedContent\"><br \/>\n<\/span><\/p>\n<p><span id=\"page33R_mcid10\" class=\"markedContent\"><span dir=\"ltr\">5.<\/span> <span dir=\"ltr\">For the success of the Europea<\/span><span dir=\"ltr\">n Green Deal and the EU\u2019s strategic autonomy, it is<\/span> <span dir=\"ltr\">critical to prioritise a circular economy approach in the CRMA<\/span><span dir=\"ltr\">. This includes <\/span><span dir=\"ltr\">implementing an ambitious recycling strategy, enhancing coherence with the waste<\/span> <span dir=\"ltr\">hierarchy, increasing EU recycling capacity ta<\/span><span dir=\"ltr\">rgets, improving collection and separation <\/span><span dir=\"ltr\">of critical raw materials (CRM)<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">containing components, proposing recycled content <\/span><span dir=\"ltr\">Targets for all CRM<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">containing products, incorporated measures for public <\/span><span dir=\"ltr\">procurement, and ensuring that the recovery of mining wa<\/span><span dir=\"ltr\">Ste follows comprehensive <\/span><span dir=\"ltr\">Regulations and includes plans for remediation of historical pollution.<\/span><\/span><\/p>\n<p><span id=\"page35R_mcid0\" class=\"markedContent\"><span dir=\"ltr\">6.<\/span> <span dir=\"ltr\">The CRMA should include<\/span> <span dir=\"ltr\">comprehensive rules for calculating and verifying the <\/span><span dir=\"ltr\">environmental footprint of critical raw materials<\/span><span dir=\"ltr\">. This requires clear criteria<\/span> <span dir=\"ltr\">for <\/span><span dir=\"ltr\">determining a significant environmental footprint, taking into account the impact on<\/span> <span dir=\"ltr\">circularity and recycling, international standards, and sustainable practices, conducting <\/span><span dir=\"ltr\">prior assessments and consultations with relevant stakeholders, allowing the <\/span><span dir=\"ltr\">European Scientific Advisory Board on Climate Change to provide scientific advice,<\/span> <span dir=\"ltr\">ensuring environmental footprint declarations for all critical raw materials placed on <\/span><span dir=\"ltr\">the market, including intermediate and final products, and the adoption of delegated <\/span><span dir=\"ltr\">acts to establish environmental footprint performance classes with specific<\/span> <span dir=\"ltr\">parameters.<\/span><\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>In September 2022, EU Commission President Ursula von der Leyen announced \u201ca European law on critical raw materials\u201d in her State of the EU address the Critical Raw Materials Act (CRMA). \u201cWe will work on strategic projects along the entire supply chain \u2013 from extraction to refining, from processing to recycling,\u201d she added.
